Lanla reserves the right to modify or alter this privacy policy at any time, particularly for the purpose of compliance with developments in legislation, regulations, case law, or technology. In such an event, the date of the last update will be clearly indicated at the beginning of this policy. The User shall be bound by these modifications as soon as they are published online. As such, the User must therefore regularly refer to this privacy and cookie policy in order to stay informed of any potential modifications.
I. Personal data
In accordance with Quebec law, we define personal information as any information that relates to a natural person and allows that person to be identified.
As a general rule, you may access Lanla’s website without disclosing any private information about yourself. In any event, you are in no way under any obligation to disclose such information to Lanla.
Nonetheless, by declining to do so, you may not be able to fully benefit from certain information or services that you request. Therefore, in certain cases, and notably when you sign up as a Mystery Shopper, Lanla may request that you provide your first name, last name, mailing address, email address telephone number, gender, date of birth, education, profession, company name, title, and salary (hereinafter referred to as “Personal Information”). By providing such information, you expressly consent to Lanla processing it for the purposes set out in Point 2 below as well as for the purposes stated at the end of each form.
In accordance with the European General Data Protection Regulation (GDPR), adopted by the European Parliament on April 14, 2016; the amended French Data Protection Code of January 6, 1978; and the Quebec Act respecting the protection of personal information in the private sector (chapter P-39.1), Lanla hereby informs you of the following:
1. Identity of the data controller
The data controller is the company 9120-6094 Québec Inc., headquartered at 207-450 Sir-Wilfrid-Laurier Boulevard, Mont‑Saint‑Hilaire, Quebec, J3H 3N9, Canada.
2. Purposes of processing
Lanla may potentially process your Personal Information for the following purposes:
(a) providing the information or services that you have requested (in particular, sending newsletters, Mystery Shopper missions, commercial offers, or white papers, or determining your level of satisfaction via a survey); and/or
(b) gathering information that would allow us to improve our Website, products, and services (in particular through the use of cookies); and/or
(c) contacting you about various events relating to Lanla, in particular product updates and client support; and/or
(d) employing statistical analyses or AI-based machine learning used to generate recommendations at points of service aimed at improving the customer experience.
3. Recipients
Lanla is the sole recipient of your Personal Information. Regardless of whether it was gathered individually or aggregated, your Personal Information will never be disclosed to any third parties other than the data processors acting under Lanla’s instructions (further information about them is provided in Point 7 below). Neither Lanla nor any of its data processors is involved in the sale of the personal data of visitors and Users of its Website.
4. Retention duration
Lanla will retain your Personal Information only for the duration corresponding to the purpose for which such information was gathered, as indicated in Point 2 above.
5. Data protection rights
You hold the following rights with regard to your Personal Information, which you may assert by writing to us at the mailing address indicated in Point 1.
Right to access and communicate data
This means that you are entitled to access your own Personal Information.
You may exercise this right by sending a notice to the owners of the Website at the following address: info@lanla.com.
Nonetheless, as part of Lanla’s duty to ensure the security and privacy of the personal data that it processes, you are hereby informed that your request will be processed on the condition that you furnish proof of your identity by producing a signed photocopy of an identification document.
Lanla reserves the right, whenever necessary, to deny improper requests if they are submitted repeatedly, systematically, or in excessive quantities.
Right to request rectification
This right means that you are entitled, under the relevant legislation, to require the rectification, update, blocking, or erasure of your personal data in the event it is inaccurate, incorrect, incomplete, or obsolete.
You may also define general and particular directives on how your personal data is to be processed after your death. Unless otherwise specified, the heirs of a deceased person are entitled to require that data controllers take into account the deceased person’s death and/or carry out the necessary updates.
Right to object
This right may only be asserted in either of the two following situations:
When this right is asserted on the basis of legitimate reasons; or
When the purpose of asserting this right is to prevent gathered data from being used for commercial prospecting purposes.
6. Response time
Lanla undertakes to respond to your request for access, rectification, or objection, or for any additional information within a reasonable time frame that shall not exceed one month from the date on which the request was received.
7. Security of Personal Information
We recognize that our clients trust us to protect their Personal Information. We take this responsibility seriously. We have taken measures to protect personal information in our custody and control. Access to this Personal Information is restricted to those of our employees and authorized service providers who require it for the purposes described in this Privacy Policy. We have taken reasonable administrative, technical, and physical protection measures to guard against unauthorized access, use, modification, and disclosure of Personal Information in our custody and control.
To provide you with an even greater level of security, online access to certain Personal Information can be protected by the password of your choice. We strongly recommend that you do not divulge your password to anyone. Lanla will never ask you for your password in an unsolicited communication.
Notwithstanding the foregoing, you should know that, unfortunately, no data transmitted over the Internet can be considered absolutely safe. As a result, Lanla makes no claim or guarantee that Personal Information will not be lost, misused, or modified, and assumes no responsibility regarding Personal Information you provide to us or the use or misuse of Personal Information by you or third parties.
8. Authorized service providers and forwarding of data to another country within the European Lanla
Lanla relies on a network of authorized service providers to facilitate the gathering and processing of data that you disclose to us. These service providers may be located outside the European Lanla and have been authorized to access data gathered by way of the various forms provided on the Website (except for the form allowing you to assert your data protection rights, which is processed only by Lanla).
Lanla has ensured in advance that its service providers have implemented adequate measures to meet stringent conditions with regard to the privacy, use, and protection of data. In particular, special care has been taken to ensure that there is a valid legal basis for forwarding data to another country.
